    May I also point out that under section 114 of the Constitution, the Commonwealth Government is prohibited from collecting tax from a State Government property, unless agreed to by the State Government as what took place with the GST. The NSW Government own the biggest Carbon emitters in the country, eg Macquarie and Delta power. Under section 114 this tax grab against State own power generators is in fact illegal

      Thanks for this Scott … I had only briefly considered this point (s.114). I am quietly confident that this legislation – some 1100 pages – involves multiple breaches of multiple sections of the Constitution.

      Scott not being that informed but I agree with you. It is like this proposed pokie reform that will effect employment etc., in the club and pub industries or associated service industries.. I have a special interest in this as my son works for a large club. I do play the pokies occasionally, but I expect to lose my investment. It is a savage recreation for sure. It is fun though while it lasts I wish I had more money to spend doing it but haven’t. But trying to enforce a federal law on the States? Where they will lose revenue that goes to pay for other services and infrastructures. Just on the high moral ground that Wilkie and others seem to take that will not deter a really compulsive gambler. They reckon a compulsive gambler will be restricted if they spend more than $1 a turn. Stupid, most pokie players don’t spend that much. Maybe 20, 40 or 60 cents a go. The States could rebel and take the Federal government to court over this too. Or tell them to go and get stuffed and do their worst. Take a horse to water but you can’t make it drink! Shame this Wilkie thing won’t cum before the carbon tax legislation or he will not support them.

      Thanks Michael. You are quite correct in that there have been plenty of rumours that “big players” may well mount legal challenges. I for one certainly hope that they do .. as they have very deep pockets. However, I think it worthwhile for the JSC to be aware that “the people” are aware of the question marks over Constitutionality of the legislation, and they are suitably incensed as to be prepared to see their concerns heard in Court if necessary. Especially since this (illegitimate) government is clearly hellbent on ramming this legislation through Parliament with near-zero scrutiny or debate, and nil mandate (quite the opposite, in fact).

      Well, yes, you’re right Bushbunny, it would’ve been great to have started this earlier. Funny thing is … I didn’t know about it earlier! Did anyone? On digging about I find that Parliament only approved having a JSC on this matter last Thursday … so they’ve basically allowed less than a week for public submissions. Given almost noone even knows about it …. ! (shrug). For my part, I was away from Wed through Sun, so only found out about it on Monday, and immediately put this submission up for readers to view and support.

    We did not vote for a carbon tax. We do not want a carbon tax.

    Carbon is not carbon dioxide. Carbon dioxide is not harmful. Carbon dioxide is a colourless gas. Carbon dioxide does not raise the temperature of the earth. The amount of reduction in ‘carbon emissions’ is in significant and therefore futile.The tax will not lower the temperature of the earth. Global warming theory has been disproved.

    I hearby signify my support for this submission. The proposed tax will have absolutely no measurable effect on the temperature of the planet and will only have the effect of penalising most Australians ( those not inside the “beltway” ),to the advantage of other countries and their citizens. No Australian government, no matter how contrived should be allowed to act against the will of the majority of the people, to put in place this pointless, punative tax / charge / excise; at the behest of and on the advice of those who do not have Australia’s interests at heart. Particularly, since as is understood, the current legislation intends to confer emission permits as personal property and therefore any subsequent repeal of the legislation will necessitate massive compensation. Much of it, unearned. Further, it is understood that the entities to be set up to make decisions with respect to future emissions targets; as well as the proposed renewable energy handouts; will not be answerable to parliament and therefore the people.

    I am against the carbon tax/ets and support this submission totally.As a low income earner I am told that I will benefit from this tax which I don’t believe because the knock on effect is I believe greater than any of us can imagine. I feel that this tax is the wrong thing at any time put forward by a government who have no right to promote a tax when they assured the electorate before the last election that it would not happen. The carbon tax will have no effect on the planet which is ever changing. It will only cause hardship and heartache to most people.

        I suppose there is that element, however they might not like each other!!
        I have noted that the French Constitutional Committee threw out their carbon tax two days before it was to be implemented. If not the G-G who do we approach to overide this unfair tax.

        It is quite clear that climate change has little to do with this tax it is purely for boosting the Government’s coffers and pandering to the Greens – at our unaffordable expense.

     I believe the imposition of this tax on Carbon dioxide is one off the most treacherous acts ever attempted on the citizens of Australia, by any government to date.

     It is a scam of epic proportions,to redistribute the wealth of those who work hard to those who do not.

     Any who think this tax is going to benefit Australians are delusional and do not understand that it is a means to line pockets of UN officials and their accomplices, dictators of third world countries and will not aid the poor any where.

     I also believe it is intended to fund the foundations of global governance and will lead to Australia losing its sovereignty, subjugating us to those who care only for power and not for the people.

     There fore I oppose totally the introduction of this iniquitous tax.
